Terms of Service (AGB)

1. Scope of Application
These General Terms and Conditions (AGB) apply to the use of the marketplace platform bazar.ch (hereinafter "Bazar"), operated by Bazar.ch AG based in Zürich, Switzerland. By accessing or using our platform, you agree to be bound by these terms.
2. User Accounts
To use the full functionality of Bazar (buying and selling), registration is required. Users must be at least 18 years old and capable of entering into binding contracts. You are responsible for maintaining the confidentiality of your account credentials.
3. Marketplace & Contracts
Bazar acts solely as a platform provider. Contracts for the sale of items are concluded exclusively between the Buyer and the Seller. Bazar is not a party to these contracts and assumes no liability for the fulfillment of obligations arising from them.
4. Listings & Content
Sellers are responsible for the accuracy and legality of their listings. Prohibited items (illegal goods, weapons, counterfeits, etc.) will be removed immediately. We reserve the right to ban users who violate these rules.
5. Fees & Payments
Registration is free. Success fees for sold items are calculated based on our current Fee Schedule. All fees are in Swiss Francs (CHF) and include statutory VAT where applicable.
6. Liability
Bazar is liable only for direct damages caused by intentional misconduct or gross negligence. Liability for slight negligence, indirect damages, or consequential damages is excluded to the extent permitted by Swiss law (OR Art. 100).
7. Data Protection
We process personal data in accordance with the Swiss Federal Act on Data Protection (nFADP). Please refer to our Privacy Policy for details.
8. Applicable Law & Jurisdiction
These terms are governed by Swiss substantive law. The exclusive place of jurisdiction for all disputes arising from or in connection with these terms is Zürich, Switzerland.
